FitLifeTrix.com respects the intellectual property rights of others and expects our users, contributors, and readers to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we have adopted the following policy for addressing claims of copyright infringement related to content published on our Site.
1. Our Commitment to Copyright Protection
All content published on FitLifeTrix.com, including articles, images, graphics, and other materials, is either originally created by our team, properly licensed, or used in accordance with fair use principles. We take copyright infringement seriously, both in terms of protecting our own original content and respecting the intellectual property rights of others.
If you believe that content on our Site infringes upon your copyright, we provide a clear process for submitting a takedown notice, as outlined below.
2. Filing a DMCA Takedown Notice
If you are a copyright owner, or authorized to act on behalf of one, and you believe that content on FitLifeTrix.com infringes upon your copyrighted work, you may submit a DMCA takedown notice to us. To be effective, your notice must include the following information, in accordance with 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing and that is to be removed, along with information reasonably sufficient to allow us to locate the material, such as the specific URL(s) of the allegedly infringing content.
- Your contact information, including your name, mailing address, telephone number, and email address, so that we may contact you regarding the complaint.
- A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information provided in the notice is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
3. Where to Send Your Notice
DMCA takedown notices should be submitted to us via email at:
Email: dmca@fitlifetrix.com
Please include “DMCA Takedown Notice” in the subject line to help us process your request efficiently. Incomplete notices may result in delays in processing your claim, so please ensure all required elements listed above are included.
4. Our Response Process
Upon receiving a valid DMCA takedown notice, we will:
- Review the notice to confirm it contains all required elements
- Investigate the claim and the content in question
- Remove or disable access to the allegedly infringing content, if warranted, in a timely manner
- Notify the individual or entity responsible for posting the content (if applicable) about the takedown
We aim to process valid DMCA notices within 5-10 business days of receipt, though this timeframe may vary depending on the complexity of the claim.
5. Counter-Notification Process
If you believe that content you posted or that is attributed to you was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to us. To be effective, your counter-notification must include the following information, in accordance with 17 U.S.C. § 512(g)(3):
- Your physical or electronic signature
- Identification of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which FitLifeTrix.com may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person
Counter-notifications should be sent to the same email address listed above: dmca@fitlifetrix.com
Upon receiving a valid counter-notification, we may, at our discretion, restore the removed content within 10-14 business days, unless the original complainant informs us that they have filed a court action seeking a court order to restrain the alleged infringer from engaging in infringing activity related to the content on our Site.
6. Repeat Infringers
In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances, access privileges for users or contributors who are determined to be repeat infringers of copyright. We reserve the right to remove content and terminate contributor access for any individual who repeatedly submits infringing material to our Site.
7. Good Faith Requirement
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing may be liable for damages. Before submitting a DMCA takedown notice, please ensure that you have a good faith belief that the use of the material in question is not authorized by the copyright owner, its agent, or the law. Misuse of the DMCA takedown process may result in legal liability.
8. Fair Use Considerations
We recognize that not all use of copyrighted material constitutes infringement. Certain uses of copyrighted content, such as commentary, criticism, news reporting, teaching, and research, may be protected under the fair use doctrine. Before submitting a takedown notice, please consider whether the use in question may qualify as fair use under applicable copyright law.
9. Our Own Content Protection
Just as we respect the intellectual property rights of others, we actively protect our own original content published on FitLifeTrix.com. If you discover that our articles, images, or other original content have been copied, republished, or used without authorization on another website or platform, we encourage you to report this to us at the email address listed above so we can take appropriate action, which may include submitting our own DMCA takedown notices to the offending platform or hosting provider.
10. Designated Copyright Agent
For the purposes of receiving DMCA notices, our designated copyright agent can be reached at:
